  1. Site Terms of Use Modifications Crussh may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.
  1. Governing Law Any claim relating to Crussh’s web site shall be governed by the laws of the UK without regard to its conflict of law provisions. General Terms and Conditions applicable to Use of a Web Site.
  2. Gift Card Terms and Conditions Gift cards can be redeemed at participating Crussh stores for all Crussh goods. They may be exchanged for goods of a higher price than the face value of the card on payment of the difference Gift cards cannot be exchanged for cash. Gift cards can be activated with a minimum value of £5.If you do not spend the entire balance on the gift card, the remaining balance will be updated after each transaction. Gift cards are valid for 12 months from the date of issue. After the expiry of this period any remaining balance will be cancelled. Balance enquiries can be obtained at participating Crussh tills Gift cards should be treated as cash. They are not cheque guarantee, credit or charge cards. Crussh will not accept liability for lost, stolen or damaged cards. Gift cards cannot be returned or refunded, except in accordance with your statutory rights, for example in the event they are not of satisfactory quality. Gift cards cannot be used in the following Crussh concessions:
  1. Crussh fit food & juice bar concession, Sainsbury’s Pimlico
  2. Crussh – Paddington Station
  3. Crussh – Kensal Rise Crussh reserves the right to amend the terms and conditions of gift cards at any time and to take appropriate action, including the cancellation of the card, if, in its discretion, it deems such action necessary. This does not affect your statutory rights.
  • Privacy Policy Your privacy is very important to us. Accordingly, we have developed this Policy in order for you to understand how we collect, use, communicate and disclose and make use of personal information. The following outlines our privacy policy.
    • Before or at the time of collecting personal information, we will identify the purposes for which information is being collected.
    • We will collect and use of personal information solely with the objective of fulfilling those purposes specified by us and for other compatible purposes, unless we obtain the consent of the individual concerned or as required by law.

  • ## Eligibility The Application may only be used by individuals aged thirteen (13) years or older. If the User is thirteen (13) years or older but under the age of eighteen (18) years, User should review these Terms with User’s parent or guardian to make sure the User and User’s parent or guardian understand them. User represent and warrants that (a) he/she is not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a “terrorist supporting” country; and (b) he/she is not listed on any U.S. government list of prohibited or restricted parties.
  • ## Apple Terms and Conditions; Crussh Policies These Terms supplement and incorporate (a) the Apple, Inc. (“Apple”) Terms and Conditions (located atwww.apple.com/legal/internet-services/itunes/uk/terms.html#service) including, without limitation, the Licensed Application End User License Agreement provided therein (“Apple Terms”); and (b) other Crussh policies, posted at https://crussh.com (“Crussh Website”). If any of the provisions of the Apple Terms and Conditions or any applicable Crussh policies conflict with these Terms, these Terms will control, solely to the extent such terms apply to the Application.
  • ## User License Subject to these Terms, Crussh grants the User a personal, non-exclusive, non-transferable, limited, and revocable license to use the Application for personal use only on an iOS product (a “Device”) owned or controlled by User as permitted by the Usage Rules contained in the Apple Terms and in accordance with these Terms (“User License”). Any use of the Application in any other manner, including, without limitation, resale, transfer, modification or distribution of the Application or text, pictures, music, barcodes, video, data, hyperlinks, displays, and other content associated with the Application (“Content”) is prohibited. These Terms and User License also govern any updates to, or supplements or replacements for, this Application unless separate terms accompany such updates, supplements, or replacements, in which case the separate terms will apply.
  • ## Mobile Payment Users who download the Application to a Device may also elect to participate in certain functionality of the Application which will allow the User to use a Device to purchase Crussh products in the same manner as is possible via cash, credit or debit card transaction in store. Use of the Application constitutes acceptance of the Account Terms of Use and Agreement. Mobile Payment through the application is accepted at participating Crussh company owned retail stores in the UK. A list of retail locations accepting Mobile Payment can be found by utilising the store locator within the application. Crussh reserves the right at any time to discontinue Mobile Payment or change the location of stores accepting Mobile Payment.
  • ## User Information Some functionality of the Application, including Mobile Payment, location based services and functionality, and access of User’s address book may require the transmission of information provided by the User including user names and passwords, addresses, e-mail addresses, financial information (such as credit card numbers), or GPS location (“User Information”). If the User uses such Application functionality, the User consents to the transmission of User Information to Crussh and/or its agents and authorises Crussh and/or its agents to record, process, and store such User Information as necessary for the Application functionality and for purposes described in the Crussh Privacy Policy (located at crussh.com). The User is solely responsible for maintenance of the confidentiality and security of any User Information transmitted from or stored on a Device for purposes of the Application, including Mobile Payment, for all transactions and other activities undertaken with any Crussh Card registered in the User’s name, whether authorised or unauthorised. The User agrees to immediately notify Crussh of any unauthorised transactions associated with the Application including Mobile Payment or any other breach of security. Crussh shall not be responsible for any losses arising out of the loss or theft of User Information transmitted from or stored on a Device or from unauthorised or fraudulent transactions associated with Application, unless such transactions are reported to Crussh in accordance with the Crussh Card Account Terms of Use.
  • ## Email Communications and Push Notifications If a User signs up for a Crussh account using the Application, the User is, by default, opted in to receive promotional email communications from Crussh (“Email Communications”). The User may, at the time of sign up, opt out of receiving Email Communications from Crussh. Thereafter, the User may opt out of email notification by emailing appydays@crussh.com requesting they be removed from our central mailing list. Similarly, upon download of this Application, the User is provided the option to opt into receiving push notifications from Crussh on their Device and within the Application. This may include promotional communications, Pick of the Week offers, and system messages pushed to the Device or within the Application mailbox (“Push Notifications”). The User may, at any time following download of this Application, opt out of receiving Push Notifications by type by adjusting the “Crussh Notifications” switch within the Application settings to “off”, or within the Device’s settings application under “Notifications” to completely opt out of Push Notifications. Opting out of Push Notifications will not affect User settings with respect to Email Communications.
  • ## Acceptable Use User’s use of the Application, any Content, and User Information transmitted in connection with the Application is limited to the contemplated functionality of the Application. In no event may the Application be used in a manner that (a) harasses, abuses, stalks, threatens, defames, or otherwise infringes or violates the rights of any other party (including but not limited to rights of publicity or other proprietary rights); (b) is unlawful, fraudulent, or deceptive; (c) uses technology or other means to access KRUSH GLOBAL or Content that is not authorised by KRUSH GLOBAL; (d) uses or launches any automated system, including without limitation, “robots,” “spiders,” or “offline readers,” to access KRUSH GLOBAL or Content; (e) attempts to introduce viruses or any other computer code, files, or programs that interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment; (f) attempts to gain unauthorised access to Crussh computer network or user accounts; (g) encourages in conduct that would constitute a criminal offense or that gives rise to civil liability; (h) violates these Terms; (i) attempts to damage, disable, overburden, or impair Crussh servers or networks; or (j) fails to comply with applicable third party terms (collectively “Acceptable Use”). Crussh reserves the right, in its sole discretion, to terminate any User License, terminate any User’s participation in Mobile Payment, remove Content, or assert legal action with respect to Content or use of the Application, including Mobile Payment, that Crussh reasonably believes is or might be in violation of these Terms, Apple Terms, or Crussh policies including the. Crussh failure or delay in taking such actions does not constitute a waiver of its rights to enforce these Terms.
  • ## Indemnification The User agrees to defend, indemnify, and hold harmless Crussh, its parent and other affiliated companies, and their employees, contractors, officers, and directors from any and all claims, suits, damages, costs, lawsuits, fines, penalties, liabilities, expenses (including attorney’s fees) that arise from the User’s use or misuse of the Application (including Mobile Payment), violation of these Terms, or violation of any rights of a third party. Crussh reserves the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by the User, in which event the User will cooperate in asserting any available defences. In the event of any third party claim that the Application or User’s possession and use of the Application infringes that third party’s intellectual property right, Crussh, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.
  • ## Warranties; Disclaimers Crussh IS PROVIDING THE APPLICATION TO THE USER “AS IS” AND THE USER IS USING THE APPLICATION AT HIS OR HER OWN RISK. TO THE FULLEST EXTENT ALLOWABLE UNDER APPLICABLE LAW, Crussh DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES THAT THE APPLICATION IS MERCHANTABLE, RELIABLE, ACCURATE, FIT FOR A PARTICULAR PURPOSE OR NEED, NON-INFRINGING, FREE OF DEFECTS OR ABLE TO OPERATE ON AN UNINTERRUPTED BASIS, THAT THE USE OF THE APPLICATION BY THE USER IS IN COMPLIANCE WITH LAWS APPLICABLE TO THE USER, OR THAT USER INFORMATION TRANSMITTED IN CONNECTION WITH THE APPLICATION (INCLUDING AS PART OF MOBILE PAYMENT) WILL BE SUCCESSFULLY, ACCURATELY, OR SECURELY TRANSMITTED. In the event of any failure of the Application to conform to any applicable warranty, User may notify Apple, and Apple will refund the purchase price for the Application to the User and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Crussh sole responsibility. Additionally, Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application. Crussh, not Apple, is responsible for addressing any claims of the User or any third party relating to this Application.
  • ## Marks, Application and Content Crussh Fit Food & Juice Bars, Crussh, the Crussh logo, and other Crussh trademarks, service marks, graphics, and logos used in connection with the Application are trademarks or registered trademarks of Crussh Corporation (collectively “Crussh Marks”). Other trademarks, service marks, graphics and logos used in connection with the Application are the trademarks of their respective owners (collectively “Third Party Marks”). The Crussh Marks and Third Party Marks may not be copied, imitated, or used, in whole or in part, without the prior written permission of Crussh or the applicable trademark holder. The Application and the Content are protected by copyright, trademark, patent, trade secret, international treaties, laws, and other proprietary rights and also may have security components that protect digital information only as authorised by Crussh or the owner of the Content.
  • ## Governing Law and Jurisdiction These Terms are governed by the laws of England and Wales. The United Nations Convention on Contracts for the International Sale of Goods shall have no applicability. The User irrevocably consents to the exclusive jurisdiction of the courts of England and Wales, for purposes of any legal action arising out of or related to the use of the Application or these Terms.
  • ## Third Party Beneficiary Apple and Apple’s subsidiaries are third party beneficiaries of these Terms. Upon User’s acceptance of these Terms Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against User as a third party beneficiary thereof.
  • ## Changes Crussh reserves the right to change or modify these Terms or any other Crussh policies related to use of the Application at any time and at its sole discretion by changing these Terms within the Application or by posting revisions on the Crussh Website. Continued use of the Application following such changes or modifications to the Terms or other Crussh policies will constitute acceptance of such changes or modifications.

  • # MOBILE APP PRIVACY POLICY The Crussh mobile application (“the Crussh App”) is owned and operated by Crussh. This policy, together with our MOBILE APP TERMS OF USE, explain how we may use information we collect about you, as well as your rights over any personal information we hold about you. Please read this policy and our MOBILE TERMS OF USE carefully; by using the Crussh App you confirm you have understood and agreed to them.
  • ## Information we collect about you through the Crussh App We collect information about you when you: *   register to use the Crussh App; *   attempt to “check in” to one of our stores; *   register your debit or credit card details; *   upload a profile photo, and *   use the payments facility in the Crussh App to pay for your purchase.
  • ## Using your information Collecting personal information in the Crussh App (name, email address, date of birth) helps us to better understand what you need from us. We use your information to: *   improve the functionality and performance of the Crussh App; *   personalise our services to you; *   tell you about important changes to the Crussh App and related services, and *   manage promotions, competitions, customer surveys and questionnaires. Your personal information is safe with us and will never be released to third party companies for marketing purposes. The Crussh App captures your geographic location when you attempt to “check in” to one of our stores. We do this to identify which store you are in or near to allow you to pay using the Crussh App, and to provide an enhanced visitor experience (for example, through digital loyalty cards). We will only capture this information with your consent. The Crussh App also captures basic usage metrics to help us identify any problems and to make improvements in the future. These metrics also help us understand how people use the Crussh App and how many people use the different functions within the Crussh App.
  • ## Information We Capture – Geographic location We provide enhanced store visit experiences when you choose to “check in” to one of our stores, and allow you to pay using the Crussh App Your geographic location is not associated with any personally identifiable information You may prevent the Crussh App from accessing your device’s location services, or turn off the location services of your Mobile Device. Doing so will impact the capability of the Crussh App and prevent you from enjoying an enhanced experience. – Data you share with us (Including information you give us when signing up, and information which is shared automatically, such as Device ID, and IP address) We use this data to log you in to the Crussh App and it helps us understand our customers better and present you with appropriate offers and promotions Your data is stored in an encrypted database and transferred over a secure network connection You decide which data you do and do not share with us. If you ask us to, we will update, correct or delete any data which you give to us. – Data you share with us if you log on through Facebook (Including your gender, date of birth, profile photo) We use this data to log you in to the Crussh App, and it helps us understand our customers better and potentially present you with offers and promotions Your data is stored in an encrypted database and transferred over a secure network connection You decide which data you do and do not share with us. If you ask us to, we will update, correct or delete any data which you give to us. – Your Card details Your card details are not stored on the Crussh App and they are only used in accordance with your top-up instructions Your card details are stored on secure servers You do not have to use the payments facility within the Crussh App to pay for your purchase – Your profile photo Your profile photo is used in store to verify your identity Your profile photo is just stored on the Crussh App and is not shared. If you ask us to, we will update, correct or delete your profile photo. However, you must have a profile photo if you wish to use the Crussh App to pay for your purchases. – Your purchase history We use your purchase history to send you personalised offers, and analyse which products are most likely to interest you Your data is stored in an encrypted database and transferred over a secure network connection We need to collect your purchase history in order to give you the benefit of personalised offers through the Crussh App. We will delete our records of your individual purchase history if you ask us to.
  • ## Storing your Information We will only store your information for as long as we need it to deliver the services available through the Crussh App. If you ask us to, or if you delete your account, we will delete the information linked to your account which can identify you personally, including your profile photo and personal details.
  • ## Marketing and research If you agree, we may contact you: *   with offers and information about Crussh products or services. *   for customer research, e.g. to help improve our service. Of course, the choice is entirely yours, but if you say you do not want to receive marketing information from us this will prevent you from receiving great offers or promotions that may be of interest to you. You can ask us to stop contacting you for marketing and/or research purposes by following the instructions in any such communication or by emailing us at appydays@crussh.com ## Disclosing your information We will never disclose your information to anyone outside of Crussh except where we have your consent; where we are required or permitted to do so by law; to other companies who provide a service to us for which we need to disclose some of your information; or any successors in title to our business. If we ever transfer your personal information to countries outside the European Economic Area we will ensure that appropriate security measures are taken.
